Introduction

The System Works Pty Ltd (“The System Works - Guaranteed”) respects and upholds your rights to privacy protection under the National Privacy Principles contained in the Privacy Act 1988 (incorporating the amendments contained in the Privacy Amendment (Private Sector) Act 2001) (“Act”). This policy describes how we manage any personal information we have about you.

The National Privacy Principles (“NPPs”) of the Act specify the minimum standards for the collection, use and disclosure of personal information by private sector organisations. The NPPs relate to:

  • Collection of personal information must be fair, lawful and not intrusive. Therefore, individuals are to be well informed and told the organisation’s name, purpose for collecting the information and that they can get access to their information.
  • Use and Disclosure of personal information must only be for the primary purpose for which it was collected, or for related secondary purposes. Individuals must consent to the use of their personal information for any other purpose. For example, consent will be required for the use of personal information for marketing purposes.
  • Data Quality must be accurate, complete and up-to-date when collected and whenever it is used.
  • Data Security must ensure personal information is safe from misuse, loss or unauthorised access.
  • Openness must be provided and the organisation must have a written policy outlining its information handling practices (such as this policy). On request, organisations must take steps to inform individuals what sort of information they hold, for what purposes and how they collect, hold, use and disclose that information.
  • Access to and the ability to correct personal information must be available on request by an individual.
  • Identifiers that have been assigned by the Commonwealth Government “agency” generally can not be adopted, used or disclosed.
  • Anonymity should be an option to persons dealing with the organisation, whenever it is lawful and practical to do so.
  • Transborder Data Flows are only allowed where the foreign recipient is subject to similar privacy restrictions as those set out in the Act.
  • Sensitive Information must not be collected unless the individual has consented, or in some special circumstances (such as public health and safety). Sensitive information includes information about an individual’s health.

What personal information about me does The System Works - Guaranteed hold?

We may hold the following information about you:

  • name, street, telephone number(s);
  • date of birth;
  • email address;
  • occupation; and
  • any other information received by The System Works - Guaranteed, in the course of providing you with goods or services.

What personal information is collected when using The System Works - Guaranteed Web Site ?

We may also collect some information about you when you use our website and/or client secured area on our website www.thesystemworks.com.au ("the website"):
  • when you visit the website, our server attaches a small text file, called a cookie, to your hard drive for our record keeping purposes. We do not store any information inside cookies.
  • if you visit the website to complete an online form or send us an email we will record the information you give us, including your email address.

What does The System Works - Guaranteed use cookies for?

The System Works - Guaranteed uses cookies to track where users go on our site. Our cookies embed a random identifying number on each user's browser. Then we note where your number shows up on our site. Our cookies simply identify your browser with a number so we can separate out unique users. The data lets us determine what content people like and where to put things to make them easy to find.

The System Works - Guaranteed sets one cookie on the web site. We tag your browser when you first hit our site. But, if you refuse our request to place a cookie, we'll keep asking to place one every time you move through our site. It's not that we set a lot of cookies, we've just programmed our site to set the cookie whenever an untagged user moves to any screen.

Contrary to popular fears or beliefs, cookies can not spy on or invade the privacy of Internet users. Cookies contain only information that users volunteer, and they do not have the capability of infiltrating a user's hard drive and sneaking away with personal information.

A lot of sites use cookies, but not a lot of them explain why. We want you to know where we stand on cookies, how ours work and what we use the resulting data for. If our policies on cookies change, we will advise you accordingly on our website.

What does The System Works - Guaranteed do with my personal information?

We use personal information about you:

  • to assist in providing our services to you;
  • to assist with any calls you make to us;

  • for our internal administrative, marketing, planning, product development, risk management and research requirements.

We will not disclose personal information about you to any person except in accordance with the Act.

At any time you may opt out of receiving any communications from us (other than as required for the operation of our business, eg regarding payment of your account).

Disclosure of Personal Information by The System Works - Guaranteed

We will not otherwise sell, lend, disclose or give your personal information to any external individuals or organisations unless:

  • you have consented to the disclosure;
  • The System Works - Guaranteed reasonably believes that the disclosure is necessary to prevent or lessen a serious and imminent threat to an individual’s life or health; or
  • the disclosure is required by law.

Openness

You may request access to personal information we hold about you by writing to us at the address below. Where we hold information that you are entitled to access, we will endeavour to provide you with a suitable range of choices as to how you access it (eg emailing or mailing it to you).

If you believe that personal information we hold about you is incorrect, incomplete or inaccurate, then you may request amendment of it. We will consider if the information requires amendment. If we do not agree that there are grounds for amendment, then we will add a note to the personal information stating that you disagree with it.

In this policy “personal information” has the same meaning as under the Acts. References to “We” mean The System Works Pty Ltd ACN 010 514 557, which has issued this policy.

We may change this policy from time to time. Although we intend to observe this policy at all times, it is not legally binding on The System Works - Guaranteed in any way. From time to time we may regard it as necessary or desirable to act outside the policy. The System Works - Guaranteed may do so, subject only to any other applicable contractual rights you have and any statutory rights you have under the Acts or other applicable legislation.
